1. Introduction and Acceptance of Terms

These Terms of Service (the "Terms") constitute a legally binding agreement between Ethovise Tech Private Limited (hereinafter referred to as "Ethovise Tech"), a company registered under the laws of India, with its principal place of business at Ahmednagar, Maharashtra, and any individual or entity (hereinafter referred to as the "Client") accessing or using our platform, services, applications, or website (collectively, the "Services").

By accessing or using the Services, the Client expressly acknowledges having read, understood, and agreed to be bound by these Terms. If the Client does not agree to these Terms, they must immediately discontinue use of the Services.

2. Definitions and Interpretations

Throughout these Terms, unless the context otherwise requires:

  • "Platform" refers to all digital properties owned and operated by Ethovise Tech, including but not limited to websites, applications, and software solutions.
  • "Client" refers to any individual, company, or legal entity accessing or using the Services.
  • "Content" encompasses all materials, including but not limited to text, images, graphics, logos, videos, audio files, software, code, and other intellectual property made available through the Services.
  • "Intellectual Property Rights" includes all patents, rights to inventions, copyright and related rights, trademarks, trade names, domain names, rights in goodwill, rights in designs, rights in computer software, database rights, and all other intellectual property rights.

3. Service Terms and Client Obligations

3.1. Account Registration and Security

  • The Client shall provide accurate, current, and complete information during the registration process.
  • The Client bears sole responsibility for maintaining the confidentiality of their account credentials.
  • The Client must promptly notify Ethovise Tech of any unauthorized access or security breaches.
  • Ethovise Tech reserves the right to suspend or terminate accounts that violate these Terms.

3.2. Acceptable Use Policy

  • The Client shall not engage in any activity that interferes with or disrupts the Services.
  • The Client shall not attempt to gain unauthorized access to any portion of the Services.
  • The Client shall not use the Services for any unlawful purpose or in violation of any applicable laws.
  • The Client shall not transmit any viruses, malware, or other malicious code.

4. Intellectual Property Rights

4.1. Ownership

All Intellectual Property Rights in the Services, including but not limited to software, designs, text, graphics, pictures, video, information, applications, and other files, are owned by Ethovise Tech or its licensors. Nothing in these Terms shall be construed as transferring any Intellectual Property Rights to the Client.

4.2. License Restrictions

The Client is expressly prohibited from:

  • Modifying, copying, or creating derivative works based on the Services
  • Reverse engineering, decompiling, or attempting to extract the source code
  • Removing any copyright or proprietary notices
  • Transferring, selling, or sublicensing the Services

5. Data Protection and Privacy

Ethovise Tech's collection and use of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms. The Client acknowledges having read and understood the Privacy Policy and consents to the collection, use, and disclosure of their information as described therein.

6. Limitation of Liability

6.1. To the maximum extent permitted by applicable law, Ethovise Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • The Client's use or inability to use the Services
  • Any unauthorized access to or use of our servers and/or personal information stored therein
  • Any interruption or cessation of transmission to or from the Services
  • Any bugs, viruses, or other harmful code that may be transmitted through the Services

7. Term and Termination

7.1. Ethovise Tech reserves the right, in its sole discretion, to terminate or suspend the Client's access to all or part of the Services, with or without notice, for any conduct that Ethovise Tech believes violates these Terms or is harmful to other users, Ethovise Tech, third parties, or the Services.

7.2. Upon termination, all licenses and rights to use the Services shall immediately terminate, and the Client must cease all use of the Services.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Maharashtra, India.

9. Modifications to Terms

Ethovise Tech reserves the right to modify or replace these Terms at any time. Material changes will be notified to the Client through the Platform or via email. Continued use of the Services following such notification constitutes acceptance of the modified Terms.
